Resvera Consumer Terms of Service

These Consumer Terms of Service ("Terms") govern your access to and use of the Resvera mobile applications, websites, and related services (collectively, the "Platform").
The Platform is operated by The Binary Gardener Ltd, trading as Resvera ("Resvera", "we", "us", or "our").
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
1. About Resvera
Resvera provides software that enables customers to book, and manage appointments with independent businesses, including salons, barbershops, beauty professionals, and similar service providers ("Business Partners").
Resvera is not the provider of the services booked through the Platform. Services are provided directly by Business Partners.
When you book an appointment through the Platform, a separate agreement is formed between you and the relevant Business Partner.
Business Partners are responsible for their own service delivery, cancellation, refund, and rescheduling policies except where these Terms expressly apply to customer-initiated cancellations made through the Platform.
2. Eligibility
You must be at least sixteen (16) years old to create an account and use the Platform.
By creating an account or using the Platform, you represent and warrant that:
- You are at least sixteen (16) years old;
- The information you provide is accurate and complete; and
- You will comply with these Terms and all applicable laws and regulations.
If we reasonably believe that you do not meet the eligibility requirements set out in this section, we may suspend or terminate your account and access to the Platform.
3. Your Account
You may be required to create an account to access certain features of the Platform.
You are responsible for:
- Maintaining the confidentiality of your login credentials;
- All activity conducted through your account; and
- Keeping your account information accurate and up to date.
You must notify Resvera immediately if you believe your account has been accessed without authorization.
4. Booking Appointments
The Platform allows you to make appointments with Business Partners.
When you submit a booking request:
- You agree to provide accurate information;
- You authorize any applicable payment to be processed; and
- You acknowledge that appointment availability is determined by the Business Partner.
A booking is confirmed only when confirmation is provided through the Platform.
Business Partners are solely responsible for:
- Appointment availability;
- Service quality;
- Service delivery;
- Pricing of their services; and
- Compliance with applicable laws and regulations.
5. Appointment Changes
Subject to availability, appointments may be modified through the Platform up to forty-eight (48) hours before the scheduled appointment time.
Requests to modify appointments less than forty-eight (48) hours before the scheduled appointment time may be rejected.
Availability for rescheduled appointments is determined by the Business Partner.
6. Customer Cancellations and Refunds
Customers may cancel an appointment up to forty-eight (48) hours before the scheduled appointment time.
Where a cancellation is made at least forty-eight (48) hours before the scheduled appointment time:
- The appointment payment, less any applicable non-refundable payment processing fees, will be refunded.
If a cancellation is made less than forty-eight (48) hours before the scheduled appointment time:
- The customer is not entitled to a refund under these Terms; and
- The full appointment payment may be retained by the Business Partner.
Approved refunds will be returned to the original payment method used for the booking.
Refund processing times may vary depending on your bank or payment provider.
Nothing in this section affects any rights you may have under applicable consumer protection laws.
7. Failure to Attend an Appointment
If you fail to attend a scheduled appointment without cancelling beforehand, the booking will be treated as a no-show.
In the event of a no-show:
- The customer is not entitled to a refund under these Terms; and
- The full appointment payment may be retained by the Business Partner.
8. Business Partner Cancellations
Where a Business Partner cancels an appointment, any refund, rescheduling, compensation, or alternative arrangements will be determined by the Business Partner.
Resvera provides the booking platform and is not responsible for services provided by Business Partners.
Customers should contact the relevant Business Partner regarding any cancellation initiated by that Business Partner.
9. Payments
Payments made through the Platform are processed by third-party payment providers, including Stripe.
By making a payment through the Platform, you authorize the applicable payment provider to process your transaction.
Resvera does not store complete payment card details.
You are responsible for ensuring that your payment information is accurate and valid.
10. Business Partner Services
Business Partners are independent businesses and are not employees, agents, representatives, or partners of Resvera.
Resvera does not guarantee:
- The quality of any service;
- The suitability of any Business Partner;
- The outcome of any appointment; or
- The availability of any Business Partner.
Any concerns regarding services provided by a Business Partner should be addressed directly with that Business Partner.
11. Reviews and Feedback
If the Platform allows reviews, ratings, comments, photographs, or other content ("User Content"), you agree that:
- Your User Content will be truthful and accurate;
- Your User Content will not be unlawful, abusive, defamatory, misleading, or offensive; and
- You have the right to submit the User Content.
By submitting User Content, you grant Resvera a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute such content in connection with operating and improving the Platform.
Resvera may remove User Content at its discretion.
12. Acceptable Use
You agree not to:
- Use the Platform unlawfully;
- Interfere with the operation of the Platform;
- Attempt unauthorized access to systems or accounts;
- Upload malicious software or harmful code;
- Use automated means to access the Platform without authorization;
- Impersonate another person or business; or
- Provide false or misleading information.
13. Intellectual Property
All intellectual property rights in the Platform, including software, trademarks, logos, text, graphics, and content, are owned by or licensed to Resvera.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
You are granted a limited, non-exclusive, revocable licence to use the Platform for personal, non-commercial purposes.
14. Suspension and Termination
Resvera may suspend or terminate your access to the Platform if:
- You breach these Terms;
- We reasonably suspect fraud or unlawful activity;
- We are required to do so by law; or
- Continued access may create security or operational risks.
You may stop using the Platform and close your account at any time.
15. Availability of the Platform
We aim to provide a reliable service but do not guarantee that the Platform will be available at all times.
The Platform may be unavailable due to:
- Maintenance;
- Updates;
- Technical issues; or
- Events beyond our reasonable control.
16. Disclaimer
The Platform is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Resvera disclaims all warranties, representations, and guarantees not expressly stated in these Terms.
Nothing in these Terms excludes any rights that cannot lawfully be excluded under applicable consumer protection laws.
17. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation; or
- Any liability that cannot legally be excluded or limited.
Subject to the above, Resvera shall not be liable for:
- Indirect or consequential losses;
- Loss of profits;
- Loss of business opportunity;
- Loss of goodwill; or
- Service quality issues arising from services provided by Business Partners.
18. Privacy
Your use of the Platform is subject to the Resvera Privacy Policy, which explains how we collect, use, and protect your personal information.
19. Changes to These Terms
Resvera may update these Terms from time to time.
Where changes are material, we will provide reasonable notice through the Platform or by email.
Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
20. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
21. Dispute Resolution
If you have a complaint, please contact us first so that we can attempt to resolve the matter informally.
Nothing in these Terms restricts your right to bring proceedings before a court of competent jurisdiction where required by applicable law.
